SOJUDAD TERMS OF SERVICE
Effective Date: March 24, 2026
CHAPTER 1: GENERAL PROVISIONS
Article 1 (Purpose)
These Terms of Service (hereinafter referred to as "Terms") establish the rights, obligations, and responsibilities between SOJUDAD (operated by Hong Blueberry, hereinafter referred to as "Company") and users regarding the use of the SOJUDAD online shopping mall (hereinafter referred to as "Shop"). The Shop specializes in selling Korean-made cosmetics and beauty products.
Article 2 (Definitions)
The terms used in these Terms are defined as follows:
1. "User" means any individual or entity that agrees to these Terms and registers as a member or uses the Shop as a non-member.
2. "Member" means a User who has registered personal information and created an account with the Shop.
3. "Products" means all cosmetics and beauty items offered for sale through the Shop.
4. "Order" means the act by which a User expresses intent to purchase Products through the Shop.
5. "Shipping/Delivery" means the act of the Company sending Products to the User after payment is completed.
6. "Purchase Agreement" means the contract formed between the Company and the User when an Order is confirmed.
Article 3 (Effectiveness and Modification of Terms)
1. These Terms become effective when a User agrees to them during member registration or upon use of the Shop.
2. The Company may modify these Terms at any time as necessary, provided that such modifications do not violate applicable laws and regulations.
3. When modifying these Terms, the Company will notify Users of the changes at least 14 days prior to the effective date through the Shop's notice board.
4. Users have the right to reject modified Terms; however, continued use of the Shop after the effective date constitutes acceptance of the modified Terms.
5. The most current version of these Terms is always available on the Shop.
CHAPTER 2: MEMBER REGISTRATION AND ACCOUNT MANAGEMENT
Article 4 (Member Registration)
1. Member registration is completed when a User agrees to these Terms, fills out the registration form in the format specified by the Company, and receives approval from the Company.
2. The Company may refuse registration in the following cases:
- The registration information contains false, incomplete, or inaccurate information
- The applicant is a previously terminated member applying for re-registration within six months
- There is a risk of violating applicable laws or damaging public order and decency
- The applicant does not meet other criteria set by the Company
- The applicant appears to be engaging in fraudulent activity or has a history of payment disputes
Article 5 (Account Information Management)
1. Each Member is solely responsible for maintaining the confidentiality of their user ID and password.
2. The Member is responsible for all transactions, activities, and damages resulting from the use of their account. However, the Company remains liable for losses caused by the Company's negligence.
3. Members must immediately notify the Company if they suspect their account has been compromised or misused.
4. The Company is not responsible for any unauthorized access to accounts due to the Member's failure to protect their login credentials.
Article 6 (Member Information Updates)
Members may update their personal information at any time through the account settings page. However, information such as name and date of birth registered during initial registration may only be changed for legitimate reasons with prior notification to the Company.
CHAPTER 3: PRODUCT INFORMATION AND ORDERING
Article 7 (Product Information and Description)
1. The Company strives to ensure that all product information displayed on the Shop, including prices, specifications, ingredients, and manufacturer details, is accurate and up-to-date.
2. Product images displayed on the Shop are representations only and may differ from actual colors due to variations in monitor settings, lighting conditions, and digital photography limitations.
3. Cosmetics and beauty products may produce different results based on individual skin type, skin condition, allergies, and personal chemistry. The Company is not responsible for variations in individual results or outcomes.
4. All products sold through the Shop are manufactured in Korea and comply with applicable Korean cosmetics regulations.
5. Users are responsible for reviewing product ingredients, usage instructions, and warnings before purchase, particularly if they have sensitive skin or known allergies.
Article 8 (Order Placement and Contract Formation)
1. Users may select desired Products, add them to their shopping cart, and proceed through the checkout process.
2. An Order is confirmed when the User reviews all order details (Products, quantity, shipping address, payment method) and clicks the "Place Order" or "Complete Purchase" button.
3. Following successful order placement, the Company will send a confirmation email or SMS to the User with order details and tracking information.
4. The Company may refuse an Order in the following circumstances:
- The order information contains errors or false information
- Payment processing fails or is declined
- Products are out of stock
- Technical issues prevent order completion
- The User has a history of non-payment or fraudulent activity
- Delivery to the specified address is not available
Article 9 (Product Shipping and Delivery)
1. Shipping typically begins within 2-5 business days following successful payment and order confirmation. Business days exclude weekends and public holidays.
2. Delivery timeframes may vary depending on the destination country, customs processing, shipping volume, carrier capacity, and circumstances beyond the Company's reasonable control.
3. Shipping costs are clearly displayed at checkout for each Product and order. Customers are responsible for paying any applicable customs duties, import taxes, or fees imposed by their country of residence upon delivery.
4. Users may track their shipment using the tracking number provided in the shipping confirmation email.
5. For international orders, delivery typically takes 7-30 business days depending on destination. The Company uses reputable international carriers but is not responsible for delays caused by customs or government agencies.
6. The Company is not liable for packages lost, damaged, or delayed by shipping carriers.
7. Risk of loss transfers to the User once the Product is picked up by the carrier.
CHAPTER 4: PAYMENT AND REFUNDS
Article 10 (Payment Methods)
The Company accepts the following payment methods:
- Credit cards (Visa, Mastercard, American Express)
- Debit cards
- PayPal and other digital payment processors
- Bank transfers (ACH, international wire transfers)
- Apple Pay, Google Pay, or other mobile payment methods
- Other payment methods as determined and offered by the Company from time to time
Article 11 (Payment Processing)
1. All prices are displayed in the currency selected by the User.
2. Payment is processed when the User submits their payment information during checkout.
3. The Company does not store full credit card information on its servers and relies on secure payment processors compliant with PCI DSS standards.
4. Currency exchange rates, if applicable, are determined at the time of payment.
Article 12 (Order Cancellation and Refunds)
1. Users may cancel an Order and receive a full refund if the request is made before the Product ships from the Company's warehouse. Once a shipment is initiated, cancellation is not possible.
2. Refund requests must be submitted within 30 days of the order date.
3. Upon receipt of a cancellation request, the Company will process the refund to the original payment method within 3-5 business days. Please allow additional time for your financial institution to process the refund.
4. If a User refuses delivery or the shipment is returned undelivered, the Company will process a refund minus the original shipping costs paid.
Article 13 (Returns and Exchanges)
1. Return Eligibility: Products may be returned within 30 days of delivery if they are unopened, unused, in original packaging, and in resalable condition.
2. Return Process: Users must submit a return request through the Shop's customer service. The Company will provide return shipping instructions and may provide a prepaid return label at its discretion.
3. Return Shipping Costs: For returns due to User choice or preference, the User must pay for return shipping costs. For returns due to Company error, damage during shipping, or defective Products, the Company will cover return shipping.
4. Refund Processing: Upon receipt and inspection of the returned Product, the Company will process a refund within 5-10 business days.
Article 14 (Cosmetics Return Policy - Special Provisions)
1. Opened Products: Due to hygiene and safety regulations, cosmetics and beauty products that have been opened, used, or have broken seals are not returnable under any circumstances, with limited exceptions noted below.
2. Manufacturing Defects: If a Product is defective, expired upon receipt, or arrives damaged due to shipping, the User may request a return or replacement even if the Product is opened. The User must provide evidence (photos) of the defect.
3. Wrong Product Shipped: If the Company ships an incorrect Product, the User may return it unopened or opened for a full refund or replacement.
4. Expiration Dates: The Company will not intentionally ship Products expiring within 6 months. However, the User is responsible for checking expiration dates upon receipt. Products that have expired may be returned for a refund or replacement.
5. Allergic Reactions: If a User experiences an allergic reaction, they should discontinue use immediately and consult a healthcare professional. While the Company sympathizes with such situations, returns of opened products for allergic reactions cannot be accepted unless the product is genuinely defective.
Article 15 (Non-Refundable Items)
The following items are non-refundable:
- Products that show signs of use, tampering, or damage caused by the User
- Products purchased during promotional sales or clearance events (unless defective)
- Shipping costs (except when return is due to Company error or product defect)
- Custom orders or personalized Products
CHAPTER 5: USER RESPONSIBILITIES AND OBLIGATIONS
Article 16 (Prohibited Activities)
Users agree not to engage in any of the following activities:
1. Providing false, misleading, or incomplete information during registration
2. Impersonating another person or using another's account or identity
3. Attempting to access the Shop's computer systems or networks without authorization
4. Engaging in illegal transactions or selling prohibited items
5. Uploading or transmitting viruses, malware, or any code of destructive nature
6. Attempting to gain unauthorized access to restricted areas of the Shop
7. Disrupting the normal operation or integrity of the Shop
8. Harvesting or collecting personal information of other Users
9. Posting defamatory, abusive, harassing, or offensive content
10. Attempting to circumvent payment systems or security measures
11. Reselling Products purchased from the Shop without authorization
12. Violating any applicable laws or regulations
13. Any other conduct that violates these Terms or is illegal or unethical
Article 17 (Intellectual Property Rights)
Users grant the Company a non-exclusive, royalty-free license to use any content they submit to the Shop (including reviews, comments, or photos) for marketing and operational purposes.
Article 18 (Liability for Violations)
If a User violates these Terms and causes damage to the Company or other Users, the User agrees to indemnify and hold harmless the Company and may be subject to legal action. The Company may also terminate the User's account and pursue appropriate legal remedies.
CHAPTER 6: COMPANY RESPONSIBILITIES AND LIMITATIONS
Article 19 (Limitation of Liability)
1. No Warranty: The Shop and Products are provided "as is" without warranties of any kind, either express or implied.
2. Force Majeure: The Company is not liable for service interruptions or failures caused by circumstances beyond its reasonable control, including but not limited to: natural disasters, war, terrorism, pandemics, government actions, or infrastructure failures.
3. User Responsibility: The Company is not responsible for any inconvenience resulting from User error, including but not limited to: entering incorrect shipping addresses, payment information, or product selections.
4. Accuracy of Information: While the Company strives for accuracy, it does not guarantee that all information on the Shop is current, complete, or error-free.
5. Results Not Guaranteed: The Company does not guarantee any specific results from using the Products. Individual results vary based on personal factors.
Article 20 (Disclaimer Regarding Cosmetics)
1. The Company makes no medical claims regarding any Product.
2. Cosmetics sold through the Shop are not intended to diagnose, treat, cure, or prevent any disease.
3. Users should perform a patch test before full application of any cosmetic product.
4. Pregnant women, nursing mothers, and individuals with known allergies should consult a healthcare professional before using cosmetic products.
5. If irritation occurs, discontinue use immediately and consult a physician.
6. The Company is not liable for any health consequences resulting from Product use, including but not limited to allergic reactions or adverse effects.
Article 21 (Service Maintenance)
The Company may perform scheduled or emergency maintenance on the Shop, which may temporarily interrupt service. The Company will make reasonable efforts to provide advance notice of scheduled maintenance through the Shop or via email.
Article 22 (Content Moderation)
The Company reserves the right to remove any User-generated content (reviews, comments, photos) that violates these Terms, is offensive, or is otherwise inappropriate.
CHAPTER 7: PRIVACY AND DATA PROTECTION
Article 23 (Collection and Use of Personal Information)
1. The Company collects personal information necessary to provide and improve services, including but not limited to: name, email address, shipping address, phone number, and payment information.
2. Personal information is collected only with the User's consent and for the purposes described.
3. Users who do not wish to provide personal information may be unable to use certain features of the Shop or complete purchases.
Article 24 (Data Security)
The Company implements industry-standard security measures to protect personal information from unauthorized access, alteration, or disclosure. However, no internet transmission is completely secure, and the Company cannot guarantee absolute security.
Article 25 (Third-Party Disclosure)
Personal information will not be sold, rented, or shared with third parties for marketing purposes without User consent, except as necessary to complete transactions (including payment processing and shipping) or as required by law.
Article 26 (Privacy Policy)
Users are subject to the Company's Privacy Policy in addition to these Terms. In the event of any conflict between these Terms and the Privacy Policy, the Privacy Policy shall govern matters related to personal data.
Article 27 (International Data Transfers)
By using the Shop, Users consent to the transfer of their personal information outside their country of residence for processing and storage, including to Korea where the Company is based.
CHAPTER 8: MEMBERSHIP TERMINATION AND SERVICE RESTRICTIONS
Article 28 (Account Termination)
1. Members may request account termination at any time through the account settings page.
2. Upon termination, the Member's account and associated data will be deactivated. The Company may retain certain information as required by law for a limited period.
3. Even after termination, the Member remains responsible for all unpaid orders and products in transit.
4. The Company reserves the right to permanently delete account information after a reasonable period following termination.
Article 29 (Account Suspension or Termination by Company)
The Company may suspend or terminate a User's account without advance notice if:
1. The User repeatedly violates these Terms
2. The User engages in fraudulent or illegal activity
3. The User poses a risk to the Shop's security or other Users
4. The User repeatedly refuses to accept delivered packages
5. The User has a pattern of initiating chargebacks or payment disputes
CHAPTER 9: DISPUTE RESOLUTION
Article 30 (Informal Resolution)
1. In the event of a dispute between a User and the Company, both parties agree to attempt good-faith negotiation through the Shop's customer service.
2. The User should contact customer service with detailed information about the dispute within 30 days of the incident.
3. The Company will respond to inquiries within 5 business days.
Article 31 (Formal Dispute Resolution)
1. If informal resolution fails, Users may pursue formal dispute resolution through:
- Small claims court (if applicable in the User's jurisdiction)
- Consumer protection agencies in their country
- International alternative dispute resolution services
- Litigation (as specified in Article 32)
2. For disputes involving credit card payments, Users may also initiate a chargeback with their payment processor or bank, though the Company requests that Users contact customer service first.
Article 32 (Governing Law and Jurisdiction)
1. These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.
2. Both parties agree to submit to the exclusive jurisdiction of the courts located in Seoul, South Korea for any legal proceedings arising out of or related to these Terms or the Shop.
3. Notwithstanding the above, Users in certain jurisdictions may have rights that cannot be waived. Nothing in these Terms is intended to waive mandatory consumer protections available in the User's country of residence.

Article 34 (Third-Party Links and External Content)
The Shop may contain links to third-party websites and resources. The Company is not responsible for:
1. The content, accuracy, or functionality of any third-party website
2. Any transactions completed on third-party sites
3. Any loss or damage resulting from a User's interaction with third-party sites
4. Users access third-party sites at their own risk and are encouraged to review those sites' terms and policies
Article 35 (Intellectual Property Rights)
1. All content on the Shop, including but not limited to text, images, graphics, logos, videos, and software (collectively, "Content"), is the exclusive property of the Company or its content providers.
2. Users may not reproduce, distribute, transmit, modify, or create derivative works from the Content without the Company's prior written permission.
3. Use of the Content for any commercial purpose without authorization is strictly prohibited.
4. The Company respects the intellectual property rights of others and expects Users to do the same.
Article 36 (Warranty Disclaimer)
EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SHOP WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.
Article 37 (Indemnification)
Users agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:
1. The User's violation of these Terms
2. The User's violation of any applicable law
3. The User's use of the Shop or Products
4. Any harm caused to third parties by the User
Article 38 (Interpretation)
In interpreting these Terms, ambiguities shall not be construed against the Company merely because the Company drafted the Terms. These Terms constitute the entire agreement between the User and the Company regarding the Shop and supersede all prior agreements, whether written or oral.
Article 39 (Severability)
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

SCHEDULE OF AMENDMENTS
Effective Date: March 24, 2026
These Terms of Service become effective on March 24, 2026. The Company may update these Terms from time to time. Users will be notified of material changes at least 14 days in advance, and continued use of the Shop constitutes acceptance of any amendments.
